1. Publisher and scope
Wespeer Pro is published by MAARS, the trading name of Thierry DEMARS, a sole trader operating under the French micro-enterprise scheme. The service is intended for customers acting for their professional activities. These terms govern access to the service, branding and Pro subscriptions.
2. Account and access
The customer provides accurate identity, business and billing information, verifies their email address and keeps this information up to date. They protect their credentials and client code. The client code authorizes installations and browsers to use the business workspace and must be shared only with authorized persons.
3. How the service works
Wespeer Pro provides device signaling, portal and application branding, notifications and a metadata history. File contents are transferred directly between devices using P2P and are not stored by the back office. The service is not cloud storage, a backup or an archive. The transfer size limit is 150 MB. The sender must retain the file and keep their device, application or browser tab available during the transfer. Device and network characteristics may prevent or interrupt a transfer.
4. Prices and subscriptions
Pro Flexible costs €39.00 per month, with no minimum commitment beyond the paid period. Pro Annual costs €390.00 for twelve months, payable in one payment, equivalent to €32.50 per month. This equivalent is not monthly billing. Subscriptions renew automatically on their monthly or annual schedule unless cancelled. MAARS benefits from the French VAT exemption scheme: VAT not applicable under Article 293 B of the French Tax Code, subject to the tax rules applicable to the transaction. The checkout summary displays the amount due before confirmation.
5. Subscription, payment and invoices
Subscribing requires acceptance of these terms and acknowledgment of the privacy policy. Payment is due at the start of each period and is processed by Stripe. The customer authorizes recurring payments for their plan. Invoices are available in their account. If payment fails, the customer must resolve the failure; paid features may be unavailable while the subscription is inactive. No discount is granted for early payment.
6. Cancellation and refunds
The monthly plan may be cancelled effective at the end of the paid period. The annual plan has an initial twelve-month term. Cancellation does not end access before the paid period expires. Customers may request non-renewal before the renewal date through their account when available, or by contacting contact@wespeer.com if the commitment period prevents online cancellation. Access remains available until the end of the paid period. No discretionary or pro-rata refund is offered unless required by law or expressly agreed by MAARS. This does not remove statutory remedies for a breach of contract.
7. Account deletion
Subscription cancellation and account deletion are separate actions. Commitment terms may restrict online account deletion; customers may contact MAARS for any request concerning their data. Account deletion removes associated operational data and transfer metadata, subject to legal obligations and data needed to establish or defend legal claims. Accounting records remain retained as required by applicable law.
8. Customer obligations
The customer is responsible for shared content, the rights required to transmit it, recipients and the persons they authorize to use the workspace. Unlawful content, malware, fraud, infringement of third-party rights and unauthorized access attempts are prohibited. The customer keeps their own backups and shares transfer links only with intended recipients.
9. Availability, support and liability
The service may be interrupted for maintenance, incidents or security reasons. No quantified availability level or guaranteed success of every transfer is offered. MAARS may restrict access in the event of unlawful use or a security threat to the extent necessary. Support is available at contact@wespeer.com. Each party’s liability is assessed under applicable law; these terms do not exclude liabilities or remedies that cannot lawfully be excluded.
10. Late payment by business customers
If payment is late, penalties become due without reminder from the day after the due date. The rate is the European Central Bank’s rate for its most recent refinancing operation plus ten percentage points and is no lower than three times the French statutory interest rate. A fixed €40 recovery charge is also due, subject to statutory exceptions. Additional documented recovery costs may be claimed where they exceed this fixed charge.
11. Changes and applicable law
The accepted prices and terms apply to the subscribed period. Changes affecting a future period will be communicated before taking effect so that the customer can decide whether to renew. These terms are governed by French law, subject to applicable mandatory rules. In a dispute, the parties first seek an amicable solution by contacting MAARS; otherwise, jurisdiction is determined under applicable law.
